oh sorry emma, no its not the one that has offered me a settlement. the one that has offered a settlement has luckily sent my bank statements back to me as well and i have now sent a letter asking for more money. the one im talkin about now is my OH's bank who has said they will get back to me by 21st feb, when i gave them til 14th. I followed the link from near the beginning of this thread to the bbc website and sent them an initial letter with all the charges highlighted on statements. i guess i will have to wait for a response and hope they send me the statements back? or as you say write to them and ask for all the statements. |

ok, I asked because if it was HSBC you can print off your statments online. Ok, can you or your OH remember how much the claim was for?? |

Ok Jenny, I think you either need to send a Data Protection Letter (from the Consumer Action Group website) requesting your statements. and you might get a reply from Barclays by that time. or phone up the number on the letter that you have got and politely ask them to return your statements that you sent to them. I really think you need the statements to continue with this claim. Barclays are one of the hardest to get your money back from, and if they think you haven't got the statements I am worried they will either just let this drag on or if you try and take them to court you would need the statements. |

Jenny if you want to use it, this is the Data Protection Letter. If you use it don't forget to enlcose a cheque for £10... A few tips for future claims, photocopy eveything, send all mail recorded delivery, make sure (you can check online with Royal Mail) that all letters have been received by the banks. Data Protection Act 1998 Subject Access Request ACCOUNT NUMBER: XXXXXXXXX Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable. Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee. If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.
