hi emma,
barclays have today offered £1000, and without statements im guessing its just best to accept it. I did send a letter off yesterday recorded delivery asking for statements tho.

anyway, my question is...

basically my OH is overdrawn on his bank by about £1400, this is going to be settled with a debt management company at some point. Is there any way we can request the bank give us the money in cheque form so that it doesnt just disappear into his bank?

Jenny it is up to you if you accept it or not, I have never accepted the banks offer and have always gone for the full amount. But that really is up to you.

If you want to accept their offer write back to them and say that you will accept it ONLY if they send you a cheque, however the banks have been known to be crafty and will just pay the money into the account if it is overdrawn. It the claim went to the Court stage they have to pay you however you request it.

hi emma,. if we were to fight for all of it i will have to wait for the statements to get sent back,

but doesnt seem much point if its only going to go into overdraft

Personally Jenny, I'd keep fighting with them. If you are entitled to about £2,000 they are getting away with a lot by only paying you £1,000. Don't let them win!!!!!!!!!

Having said that tho, it is totally your decision and a thousand pounds is a lot to anyone. At least you will have got something back from the robbing b***ards!!!! lol

i think i will wait to see if they send me the bank statements and i will then have something to take them to court with to ask for the rest of the money.

I dont really want £1000 to just pay off the overdraft as I think my OH would appreciate having the extra £1000 to help with his business

so the war wages on

Good decision Jenny he will be able to pay off the overdraft and still have money left

Don't forget IF you take court action you will be able to add 8% court interest to the charges as well, this can make a big difference on your claim

how much will it cost me to initiate court proceedings? i know i get it back, but will be nice to know what to expect to have to pay initially

Court fees for claims less than £5,000 are £120
