I've had a letter from the bank this morning offering me £163 out of the £342.10 I have claimed.

I added to my claim all the bank charges on my statements, including arrangement fees and international payment charges. They say that these are non-refundable.

Is that right??? EmmaG!?!?!?

I'm wondering whether to now tell them about the other lady's bank account/name/address details that they sent me, to try and bargain with them???

What do you think??

You can only claim "penalty" charges, i.e. charges for effectively doing something wrong (in the eyes of the bank) so they could be correct that some of the charges are not penalty charges, you should be looking for charges when overdrawn, bouncing cheques, card misuse fees etc.

Recheck your details and see if the offer they have given you is correct or not.

I think you will be only able to mention the other lady's details if they have got the amount of charges wrong.

Doh!!! Too late, I've written to them today.

I've written them a nice letter though, not a threatening one, just asking them to explain their charges etc etc.

I have also mentioned the other lady's details and told them that I have lost confidence in them due to this breach of client confidentiality/data protection.

I have opened another bank account elsewhere now too, as I think I'm going to leave them now regardless.

Good for you Charlie, they will still have to settle even if they can justify their other charges.

It will be interesting to see what they say about the other lady's details.

New developments recently in relation to reclaiming your charges

Natwest Defence Struck out by Reading Court !
Seems as though more and more judges have had enough of the banks constant abuse of the court process. Last month we reported on a number of claims in Lincoln where judges had threatened to strike out bank defences to penalty charge claims. A few days ago a judge at Reading County Court has issued the following order against Natwest Bank;
1. Defence struck out as an abuse of process.
2. Claimant may enter judgement for the outstanding balance of the claim and court fees and interest.
There is NO leave for Natwest to set aside,vary or stay the order.



Good to read that the courts are now realising what the banks are up to

certainly is Fran also members of the consumer action group have had charges prior to 6 years paid out

So if any Catsey members get payment for their charges and want to go back further than six years you can do (with the correct advice) you must make sure you do not sign any paperwork from the bank to say that the first claim is in full and final settlement

my daughter got a 20 quid charge all because she went 30p into the red!!!!!!!!!!!!!!!!!!!!!!!

Ridiculous isn't it BM, I was checking my statements the other day and for our Abbey account we were charged and we hadn't even gone overdrawn???? very odd and I am surprised I never noticed it.
