Well done Fran - that's fantastic!! Unfiortunately, both our claims have been 'put on hold' pending the test case. We have paid out £220 in court charges and could really do with the money, so I'm not best pleased. |

Yes Emma, the Barclays one was done by the court. We filed using MCOL and were near AQ stage, the case was sent to our local court and they have put it on hold. We have sent off the AQ for Abbey, but haven't heard back yet. Do you know if it is worth getting the stay removed and on what ground?, I have heard that the only grounds is that if the charges have made you short of money, which isn't strictly true in our case. I really wish I had accepted the £1125 they offered, which was quite generous. I just feel it is like a big black cloud hanging over us. Wonder if it is worth writing to them to see if they would reinstate their original offer? Sorry, feeling a bit down at the moment. Just come back from a great holiday too which is part of the problem! |

Kim I had a letter from HSBC I think it was urging me to accept their offer and they even mentioned the potential test cases, to me they seemed very worried that the test cases are going to go against them. (just look at the credit card charges ) No harm in giving them a call to see if you can accept their offer, they will only say no, and I think they will bite your hand off. Not sure about the grounds for the removal of the stay as I haven't been on the CAG for a considerable time now. |

Kim - here's an article from today's paper. http://business.timesonline.co.uk/to...cle2326737.ece Start of paragraph six seems to say that the bank has to honour any offer they have made. Might be what you are looking for? |

I was going to say something similar to DM, if the Bank made an offer surely it still stands and you can accept. What harm will it do to get the letter of the offer out see if there is a timescale if not - contact them Tues and accept. Karen |
