They would need a court order to send the bailiffs in, and I think the original poster would have gone to court to fight his case (he was dealing with Capital One via letter but just refused to deal with them over the phone) also the debt was due to fraud that Capital One would not do anything about, so it wasn't even his debt. In the end they stopped calling him and took no further action |
