Moving home nightmare!


Well was supposed to have moved home yesterday after spending all weekend and bank holiday monday packing up our house and loading in a van, because yesterday the contracts were supposed to be exchanged and then complete the same day. Well yesterday morning (moving day) the estate agents ring and say the vendor has pulled out!!! apparently there was a redemption fee of £9000 to pay if he paid back his mortgage before 2 years and what he is getting for the house isnt enough to cover it, and he only got the statement through yesterday. But the estate agent told me they knew something last week, i was so annoyed because they could have warned us! and we would'nt have packed the house up!
So now we might have to come up with more money, the estate agents have offered to give up most of theire fees so we only need to find £6,750
We have been renting here 4 years and our landlord has someone to move in here from saturday (so its all gone wrong)
Our landlord is coming round tonight to see if we are going to sign another tennacy so we are just waiting on the solicitors now

Oh gosh, I cannot believe this has happened I do hope you can manage to sort something out quickly, you must be feeling at your wits end at the minute

Good grief! what a situation to find yourself in! What on earth was your vendor up to? He must have known about the mortgage redemption clause from the beginning! Hope you can sort something out.

Whaaaaat?
So you were due to exchange and complete on the same day? And the vendor never exchanged? So you don't get to keep the deposit?
Sounds very off to me. Your solicitor shouldn't have let you get into a situation where you are facing a loss.
Where's Charlie? She's a conveyancer isn't she?
Kick up a fuss about this - I'm sure you shouldn't be facing a loss

Fran, we are totally gutted, we either lose £2000 which we have paid out already or put more money in so we still have the house. But its going to take time to sort out.
Our mortgage advisor said in the 35 years that he's done his job he has never known this happen on the last day!

Mys H, Yes our mortgage bloke said he would have known a couple of weeks ago and the estate agents said they did'nt want to say anything because they did'nt want to panic anyone!

We have a matress in our living room at the moment, because we have a brand new super king size bed that my parents bought us that wont fit in the house we live in now. My head feels like its going to explode! im fuming!!

Our solicitor didnt know there was a problem, the vendors solicitor was out the office last week which is'nt uncommon and they arranged to exchange tuesday morning, and our solicitor had the money in the bank ready! but the vendor instructed his solicitor not to complete.

Is this your scummy vendor trying to get more money out of you? Oh, poor me, I'm going to be £9k down.
There's something wrong here - stay strong and sort it out. Someone who was acting in your interests should have prevented this ever happening .... negligence somewhere, lack of duty of care etcl

yes we thought that too! and the estate agent that showed us round the house is friends with the vendor and his family! which makes matters worse.
We had a barney in the shop of the estate agents yesterday but they insist no one is to blame, it happens and there is nothing we can do about it
But we have asked for proof that there is a £9000 redemption.

What does your solicitor say?

If your solicitor is unhelpful, would you think of going to another one for some better advice. The half-hour scheme isn't expensive but anyway it's worth paying to get proper advice.
The estate agent sounds dodgy. I thought they were meant to disclose if they were connected to a vendor?
